New obligation to provide information for online commerce
Online retailers have been subject to a new obligation to provide information since 1 February 2017. These are stipulated in the EU Regulation No. 524/2013 (ODR regulation), which is closely related to the ADR regulation, whose implementation was adopted into German law in December 2015.
The main aim of the ODR Regulation is to set up an online dispute resolution platform (ODR platform) at EU level. The ODR platform is to be the point of contact for consumers and online traders who want to resolve any disputes resulting from legal online transactions out of court. The complaints are then forwarded to the national arbitration board responsible for the dispute concerned via the platform. This does not include offline contracts.
